TERMS AND CONDITIONS OF CONTRACT
EXTRACT FENCES ACT 1968

PAYMENTS
A 20% deposit is required with the acceptance of this quotation before any materials may be ordered, where materials must be specially ordered full material cost must be paid for upon acceptance of quote.
The balance of the contract is STRICTLY payable on completion of fence. Or if arranged prior amount is payable WITHIN 3 Days of completion after which time it becomes overdue attracting a fee of 5% of total bill after 7 days.
All materials used to fulfill the contract shall remain the absolute property of FEATURE FENCING and no right, title or interest of any kind in or to the materials shall pass to the client until FEATURE FENCING has received payment in full of the price payable on the contract. If the client fails to make payment for such materials when due it shall be lawful for FEATURE FENCING without previous notice to repossess the materials and ENTER any premises for the purpose of such repossession.

BOUNDARIES
All pegs and boundaries are to be marked by the client who shall continue to be responsible for the position of the fence and any claims arising there-from.

NEIGHBOURS (CLIENT 2 OR 3 OR 4)
The contractor shall, at the request of the client, send a fencing notice to adjoining owners of properties, However, the contractor does not bear any responsibility for failure of the owners to comply with the fencing notice on provisions of the Fences Act 1968, and in the advent the adjoining owners fail to make payment after a fence has been erected by FEATURE FENCING the TOTAL COST continues to be the responsibility of CLIENT 1. However FEATURE FENCING will apply to the civil court system (VCAT) to recover any amounts due from each non paying client in the event that amounts are outstanding after 1 month.

ELECTRICITY AND WATER SUPPLY
Either client shall supply electricity and water at all times during construction. In the event that power and water are not supplied any extra costs incurred including generator hire, cartage, loss of time or additional labor shall be charged evenly to each client.

SITE

  1. This quotation for fencing or other, unless otherwise stated, is based on construction on clear unobstructed areas.
  2. Unless otherwise provided in this quotation, the client shall clear all obstructions and provide a clear working area and access. If the client fails to remove obstructions then all costs for removal including equipment hire and labor cost at $40.00 per man per hour shall be payable by the client. Furthermore where the posts (either old or new) are required to be removed and / or installed in existing concrete (eg. Driveways, paths etc..) It is the clients responsibility to make necessary repairs (unless otherwise agreed)
  3. The client shall be responsible for locating and notifying FEATURE FENCING, it’s servants or agents at the time of construction of the position of all underground obstructions including electrical and telephone cables, gas, water, storm water, sewerage pipes and any other services facility which is or may be affected by the construction and shall indemnify FEATURE FENCING and it’s agents against any claims or demands made by any person or authority in respect of any damage if such location and notification has not been made or has not been accurately made.
  4. No allowance has been made for concealed obstructions such as but not limited to; rock, wires, pipes, tree roots, broken posts, foundations, thick or reinforced concrete, etc which may be encountered. Any costs incurred in removal of concealed obstructions including equipment hire and additional labor costs (as per shall be payable by the client).
  5. The client shall remove or protect all plants, ornaments, pipes, etc which may be damaged, However, FEATURE FENCING shall exercise all care but accept no responsibility if damaged.
PERMITS
Unless otherwise provided in this quotation the client shall obtain any necessary permits and supply a copy of the permits and conditions to FEATURE FENCING prior to construction.

FENCE HEIGHT
All heights of fence as shown shall be normal only and fences shall be constructed from standard production components that shall yield the closest height under that nominated. Fencing height usually built contours of the ground (unless otherwise stated herein) and is NOT ALWAYS LEVEL AT TOP. The fence height may vary in relation to undulation of the land along the fence line and gaps may appear under the plinth board. All heights will be measured from top to bottom of fence.

FENCE POSITION
Unless otherwise provided herein the fence shall be constructed with which side the posts are on being the discretion of the erector.
